INSTRUCTIONS: Answer any 4 questions. All questions carry equal marks.
1. Kike forcefully slapped Bose in the face. An act of Parliament states that it is an offence to hit with the palm, fist, knuckle or fingers any person on their face. By referring to the decided cases, apply three rules of interpretation to determine the legal implication of Kike’s actions.
1b. Applying the same three rules of interpretation, discuss will the outcome be different if Kike was armed with a frying pan?
2. Timon was clearing his courtyard; he picked up a stick and immediately spotted a poisonous tarantula on it, known to cause massive hemorrhage & eventual death of sting victim. He violently threw the stick which struck Pumba who was having a satisfying meal of corn & coconut at his backyard, away from his wife & children. The spider was dislodged by the violence of the throw and angrily stung Pumba’s wife who was sneaking upon him. She screamed and threw the spider over Rafiki’s fence, whom she had several times quarreled with and was quoted as saying she would deal ruthlessly with her in the near future. a. Keeping in mind above facts, identify the legal issues that can be raised?
b. What defences maybe raised by Timon in respect of criminal charges that can be brought against him?
3. Discuss extensively two major obstacles to the enforcement of Legal Rights in Nigeria. Also discuss at least three means of addressing the attendant problems they present.
