LAW 342:                   CRIMINAL LAW II

 

  1. Nick and Joshua are students at ABC Institute. On the 5th of September both Nick and Joshua went to class to study in preparation for a forthcoming exams. After some hours of study both decided to take a short break during which the bought some biscuits. Immediately Nick and Joshua left the class, John Bull also a student in the same institution entered the class and after ensuring that nobody was watching him decided to take two law text books belonging to Nick and Joshua. John Bull took the books to his hostel and hid them in his box. After about two months, John Bull decided to take the books to town and on his way one of the books fail down and was picked by Joshua’s friend who recognized the book as belonging to his friend. John Bull was arrested and charged to court. Discuss the legal issues raised in the matter.

 

(2)On the 5th of August, 2012 at about 5.00pm, Michael went to the house of Peter.  When Michael reached Peter’s house he realized that all the entrances to Peter’s house were all locked. He brought a tool from his bag and forced one of the windows open and entered into the house. Thereafter, he removed Peter’s smart phones and laptops. Michael jumped out through the same window and left. At about 11.00 pm the same day Jane went to Ken’s house, knocked on the door and informed Ken that she is one of his neighbuors. Ken opened the door upon which strangers entered his house and removed valuable items like television sets. Discuss the legal issues raised in this case.

 

(3)On the 26th of July 2012 Jackson visited Mikel Colombus in his office. Colombus is an industrial chieftain of note. Jackson introduced himself to Colombus as a beneficiary of a large estate and that he needed the sum of N20M to perfect his title to the estate. He promised to transfer a substantial portion of the estate to Colombus after perfecting his title to the estate. Colombus paid the said sum to Jackson who has disappeared without trace. Discuss the legal issues raised.

 

(4) The crime of sedition is only significant as a colonial heritage. It is neither desirable nor necessary in a democratic society. Evaluate this statement. 

 

(5) The laws relating to offences of unlawful assembly, riot and affray are essential to ensure and preserve public order. 

 

 (6) Despite the Corrupt Practices and Other Related Offences Act 2000 (popularly known as the ICPC) the fight against corruption in Nigeria remains a mirage. Discuss.

 

(7) Discuss the significance of the Economic and Financial Crimes Commission Act and the Money Laundering (prohibition) Act 2004 in Nigeria. 

 

(8) a.       Corruption pertaining to the administration of justice strikes at the heart justice delivery in Nigeria. Discuss

 

 

(9) What constitutes stealing and why is land no capable of being stolen
